Chief Executive Martin Perry has told seagulls.co.uk the club are still in the dark as to when Lewes District Council's bid to force a Judicial Review will be heard in the High Court.
Media speculation has hinted that the case will be heard in court this coming June, but Perry said, "I do not know where this date is coming from - I know that it has been referred to in the media, but as far as we are concerned that is speculation."
"Lewes do not have to seek leave to appeal the decision it will go straight to court. We are in touch with the Treasury Solicitor who is still considering how to handle the challenge and we have to wait to see the outcome of this, before we can take any action - we will follow their lead. So at this stage we still do not know when it will go to court or how long it will take.
"We are however proceeding with as much of the preparatory work that we can, but until we get this matter resolved we cannot predict when we will be in a position to commence work on site."

Perry remains hugely confident Albion will not be stopped from building at Falmer - but feels LDC's actions are merely to delay the project.
"I have no doubt that the stadium will be built. We will get permission, but it could be that by causing further delays, Lewes hope that we will be unable to sustain further losses and the extra costs that we will incur if the stadium is delayed. Is their real agenda to try to defeat the stadium by putting the football club out of business?
"All I can say to that is having fought for this for the last eight years and with the support of our unbelievable fans we are not going to let Lewes stand in our way, despite the obstacles that they try to put in front of us."
